2. What the service is
FriendlyNotifications is a platform that lets a business schedule and send courtesy messages to its own customers by SMS, WhatsApp and email.
3. SMS Terms
Anyone who agrees to receive messages through the FriendlyNotifications platform, operated by Friendly System Group LLC, does so on these terms:
- Message frequency varies; you will receive approximately 2 to 5 messages per year.
- Message and data rates may apply.
- Reply STOP to opt out at any time, and HELP for assistance. Opt-out is immediate and needs no explanation.
- We do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
- Consent is never a condition of purchasing any goods or services from the business.
4. Obligations of the contracting business
- Obtain prior express consent from each person before adding them, and keep the record of it in the platform.
- Not upload purchased lists, contacts obtained from public sources, or data of people who are not its customers.
- Be responsible for the accuracy of the data it uploads and handle its customers' access or deletion requests.
- Use the platform only for the three message types described, and not for bulk advertising, debt collection or prohibited content.
Non-compliance allows us to suspend that account's sending immediately and without prior notice, to protect deliverability for everyone else.
5. Our obligations
- Process the data solely on the business's instructions and for this platform's purposes.
- Honour every opt-out immediately and across every applicable channel.
- Not send outside the permitted hours in the recipient's own time zone.
- Disclose the sub-processors involved in delivery.
6. Billing
The service is billed per plan with a message allowance. Usage is measured in billable units: one email is one unit, and an SMS counts by segments, because that is how carriers charge. A message with accented characters or special symbols uses more segments than one without.
7. Limitations
Final delivery depends on mobile carriers and email providers, which may filter or delay messages for reasons outside the platform's control. Delivery of any individual message is not guaranteed.
8. Governing law
This service is provided in accordance with the applicable law of the countries where it operates, including Costa Rican data protection rules and United States commercial messaging regulations.
